r <br />I ■ <br />f <br />r * <br />liable to the City of Orono for any costs incurred by the City <br />of Orono should the non-budgetcd capital expenditure and/or <br />increase in number of officers be made despite such <br />disapproval. Furthermore, the cost of such disapproved <br />capital expenditures and/or increase in number of officers <br />shall not be computed in determining the "Base Cost" herein <br />above set forth for each Contract City for the years in which <br />the disapproved expenditure(s) is/are made. <br />20. Hold Harmless and Indemnification. As part of the Police <br />Budget for each contract year, the City of Orono shall <br />purchase liability insurance to insure the City of Orono <br />against liability incurred in the rendering of law enforcement <br />services to the City of Spring Park. The City of Orono shall <br />maintain insurance covering its law enforcement services with <br />limits of not less than $600,000 for general liability <br />coverage and $2 million for excess liability coverage. The <br />City of Spring Park shall maintain equivalent insurance <br />coverage. <br />Each policy procured by the City of Orono shall name the City <br />of Spring Park as an additional covered party for claims <br />aj*ising out of or related to the provision of law enforcement <br />services. Except to the extent the same are the result of the <br />negligent or wrongful intentional acts of the City of Spring <br />Park, the City of Orono agrees to defend, indemnify and ho^d <br />harmless the City of Spring Park from claims, suits, damages, <br />losses, liabilities and costs however denominated arising out <br />of or related to the provision of lav enforcement services by <br />the City of Orono, its officers, agents, employees and <br />contractors. <br />Nothing in this Agreement shall be construed as any waiver by <br />either City of any statutory or common law immunities, <br />defenses, or limits on liability. <br />In no event shall this agreement be construed to fix upon th.. <br />City of Orono any responsibility or liability to Spring Park <br />which is greater or different in kind than the <br />responsibilities and liabilities borne by Spring Park if it <br />was providing law enforcement services through its own police <br />department.
