A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECT ION 10.03, SUBDFV^ISION 14 (C), SECTION 10.22, SUBDIVISION 2, <br />SECTION 10.25, SUBDIVISION 6 (B) AND SECTION 10.56, SUBDIVISION 16 (C) (2) <br />FILE NO. IW / 9/5" <br />WHEREAS, George Applebaum (hereinafter "the applicant") is the owner of the <br />property located at 4109 Highwood Road within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Lots 17 and 18, Highwood Lake Minnetonka, Hennepin County, Minnesota <br />(hereina'*er "the property"); and <br />VVHEPr’AS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section ,0.03, Subdivision 14 (C) to permit structural improvements that will <br />result in 2,662 s.f. or 16.6% of structural coverage where only 15% is allowed; per Section <br />10.25, Subdivision 6 (B) seeks approval of side and street setback variances tor a second story <br />addition to be located 16’ from the street lot line where a 35’ setback is required and a garage <br />addition that would be located 9’ from street lot line where a 35’ setback is required and where <br />a 3 5’ setback exists and located IW from the side lot line where a 10 ’ setback is required and <br />where a 3’ setback exists; per Section 10 ’2, Subdivision 2 seeks approval of hardcover <br />variances within the 75-250’ setback area where 3.423 s.f. or 41.5% exists and where 3,557 s.f. <br />or 43.1 % is proposed and where 25% is allowed; and per Section 10.56, SuMivision 16 (C) (2) <br />seeks approval of setback variances from the defined top of the bluff requiring a 30 setback <br />where the garage is proposed at 20 ’; a cantilevered second story at 8 ’, grade level addition at <br />lakeside is 12 ’ and a lakeside deck at o'/i’. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />1. <br />FINDINGS <br />This application was reviewed as Zoning File <br />The property is located in the LR-IB Lakeshore Residential Zoning District <br />requiring one acre in area.
