Mabusih <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #1904 Eric and Shelly Liljequist, 3490 Birch Lane - Conditional Use <br />Permil/Variance <br />Additional List of Exhibits <br />I - MCWD Permit #94-76 <br />Brief Review of Application <br />The entire footprint of the Liljequist residence is located within the tlood plain of Uke <br />Minnetonka. The structure is to be completely rebuilt with new foundation. A conditional use <br />permit and variance is required as work is done within the shoreland and new construction <br />involves permanent structure within the flood plain ot Lake Minnetonka. Applicants have <br />completed their review before the Watershed District and have received approval. Review <br />Exhibit F. 1, and J. The Watershed District has approved a retention plan providing tor <br />mitigation/retention area to the street side of the residence. Shawn Gustafson has provided <br />another alternative, review Exhibit H, that would allow for the creation of a swale along the <br />west side of the residence providing for positive drainage towards the lake and away trom <br />residence. Gustafson is concerned that with the mitigation pond to the rear or street side of <br />residence that positive drainage would not be achieved and that it will be necessary to create a <br />swale leading from retention area. <br />In recent discussions with Ellen Sones of the Watershed District, she also concurred that <br />it would be necessary to maintain positive drainage and that a swale is needed providing for <br />positive drainage from the mitigation area at the south. <br />The applicant has been offered two alternatives for mitigation of the filling of the flood <br />plain. It is staffs understanding that the Liljequists prefer the original plan approved by the <br />Watershed District. It will be the applicants’ responsibility to provide a drainage plan <br />designating a 1:1 mitigation of the filling of the flood plain and providing positive drainage on <br />the property. The City will ask that the engineer review that grading and drainage plan and <br />complete the necessary inspections on site.
