Mabusth <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #1927 Mary McCarty. 245 Tonka Avenue - Variance - Resolution <br />Brief Review of Application <br />Council granted an area variance for Lots 5 and 6 in July of 1993. During the review, the <br />applicant advised that she was attempting to acquire the soon to be tax forfeited lots to the <br />immediate north. The current application now includes Lots 3 and 4 and involves a lot area <br />variance and rear setback variance. A lot width variance is no longer required as total building <br />site meets the 200’ requirement and the area has been increased to 25,050 s.f. <br />Because of certain physical site constraints such as a low retention area in the south end within <br />Lot 6 and the location of mature trees at the west and mid points of Lots 4 and 5. (Review <br />Exhibit F), the single story structure will be located 30’ from the west or rear lot line. Review <br />Exhibit G,' the applicant proposes to design the home in order to fit the existing neighborhood <br />of cottage-like structures. If the structure was to be realigned in a north and south alignment <br />within the legal building envelope, this would no longer be possible. <br />The Planning Commission accepted the hardships noted by the applicant and recommended <br />unanimous approval of the rear setback variance as proposed. The enclosed resolution has been <br />drafted per the findings and conditions of the Planning Commission’s recommendation. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed application resolution.
