Request for Council Action continued <br />page 2 of 2 <br />May 19, 1994 <br />Zoning File #1925 <br />Applicant explained he has removed the deteriorating 8 ’xl4’ deck that was constructed in 1976. <br />Please review the 1976 plans. Exhibit E. That deck was part of the 14’x25’ 1976 addition <br />covered under permit #3372. Applicant’s roof proposal drawings (5/10/94 Exhibits E), upon <br />close scrutiny, suggest this will be replaced as a bedroom extension in line with the existing <br />northeast wall'of the house, matching the footprint shown on the old survey, although applicant <br />notes he might decide to just replace it as a deck in line with the northeast wall. <br />Whether deck or bedroom expansion, any portion of the proposal less than 30 ’ from the side lot <br />line, also requires a side setback variance. The 1976 survey was not of a scale that direct <br />measurement could be accurate, and staffs calculations based on that survey indicated a setback <br />of 29.25’. After discussions with staff, applicant agreed to provide an updated certificate of <br />survey and verification of the setback to the proposed deck/bedroom addition. The new survey <br />shows that the comer of the proposed addition will be 29.0 from the side lot line, a triangular <br />encroachment of approximately 1.0 s.f. in area. <br />Staff Recommendation <br />Given the almost insignificant encroachment, staff recommends this additional side setback <br />variance be granted in addition to that for the roof revisions. The attached resolution covers <br />both items. <br />Council Action Requested: <br />Adopt resolution granting front and side setback variances for roof expansion and side setback <br />variance for room expansion for Peter Bovee, 840 Old Long Lake Road.
