The Minnehaha Creek <br />Watershed Distrkt has tabled the application pending City approval. *The Watershed District <br />and applicants' engineer have met to discuss the culvert sizing to ensure no impact on properties <br />upstream. <br />Easement Issue Resolved <br />The outlot in which the driveway is proposed to be constructed is owned by the next door <br />neichbor, James Lawrence, who apparently is opposed to the driveway. Because staff required <br />Lawrence ’s signature on the application before accepting it as complete, applicants pursued and <br />obtained a Declaratory Judgement from the Hennepin County District Court confirming that <br />Whitmans' easement over the outlot gives them the right to construct driveway within the <br />easement without the Lawrences approval. This is documented in Exhibit L. <br />Proposed Grading Plan <br />Exhibit E is a topographic review of the general area of the proposed crossing. There <br />is a driveway culvert approximately 600’ upstream serving the end house on Tanglewood Road. <br />The 48" culvert proposed is the same size as the culvert downstream which not only takes the <br />flow from the Holy Name tributary but also from that leading to Long Lake from Wolsfeld <br />Lake. The Watershed District is expected to approve the size of the culvert as proposed. City <br />Engineer Shawn Gustafson has reviewed the site and has no problems conceptually with the plan. <br />He did recommend to staff that the proposed 2:1 slopes on the stream crossing be constructed <br />at a 3:1 slope. This requirement will be passed on to the Watershed District for their review. <br />The total length of driveway to be constructed is approximately 450’ and will involve the <br />movement of approximately 1.000 cubic yards of material. A significant portion of the stream <br />crossing fill will likely be generated from construction of the driveway, although some <br />importation of fill may be necessary . <br />Conditions of Approval <br />The Shoreland Regulations, Section 10.56, Subdivision 16 (J) provide a number of <br />considerations and conditions ("Best Management Practices") that must be adhered to during <br />construction projects such as that proposed: <br />• Alterations must be designed and conducted in a manner that ensures only the <br />smallest amount of bare ground is exposed for the shortest time possible. <br />• Mulches or similar matenals must be used where necessary for temporary bare <br />soil coverage and permanent vegetation cover must be established as soon as <br />possible.
