Request for Council Action continiKd <br />page 3 of 3 <br />May 2, 1994 <br />Sandy Beach Joint Use Dock License - Requested Amendment <br />to the license; <br />"3. During the current license period, the City reserves the right to require a <br />reduction in the number of licensed slips commensurate with any reductions of <br />habitable dwelling units which may occur during the license year." <br />The City followed through on this in 1993 after removal of the first cabin, and again in <br />1994 after a second cabin was removed, leaving 5 licensed slips. <br />After reviewing the man>- file documents that provide a historic background on Sandy <br />Beach, sUff feels it is reasonable to infer from past license and CUP approvals that the City <br />intended that as the number of cabins decreases the number of slips should commensurately <br />decrease. Zuckman points out that past licenses have not required that the number of slips be <br />commensurate with the number of rental units, only that the City "reserves the right" to reduce <br />the number of slips commensurate w ith reductions in rental units. It can be argued that this is <br />merely an exercise in semantics, and that the City ’s intent has clearly been to allow no more <br />slips than there are cabins. It is a fact, however, that until 1991 the City did not formally <br />address reductions in the number of slips as rental unit attrition occurred. <br />Staff has «iviscd LMCD of the 1993 and 1994 reductions. <br />Staff Recominendation <br />Staff recommends that the number of slips be limited to 5, commensurate with the 5 <br />cabins still existing on the property. Mr. Zuckman has been advised of this meeting and will <br />be present to discuss the matter. <br />Options for Council Action <br />1. Approve request to allow 6 slips for 5 cabins. <br />2. Deny request. <br />3. Table or refer to Lake Use Committee for review. <br />4. Other.
