Request for Council Action continued <br />page 2 of 3 <br />May 2. 1994 <br />Sandy Beach Joint Use Dock License - Requested Amendment <br />Background <br />In 1968 the City granted this propert)’ a CUP for a non-conforming use as a resc-rt u ith <br />rental cabins. By the late 1970’s, the status of those cabins had changed to a year-round rental <br />"multiple dwelling" use. A 1982 LMCD review of the site apparently prompted the City to <br />require an upgrade of the CUP as well as require a Joint Use Dock License for the site. <br />A. 1983 Joint Use Dock License. <br />A review of the memos and minutes from the 1983 Joint Use Dock License application <br />suggests that the City accepted the proposed 7 slips for 7 rental units as reasonable given the <br />historic level of use of the site. In that Joint Use Dock License, the issue of what would happen <br />if number of cabins decreased, was not specifically addressed. The only special conditions <br />placed on that license were: <br />1 The City will require written approval from abutting and affected property owners <br />for each annual license review. <br />2. The 7 approved slips are for the exclusive use of the residents/renters of Sandy Beach <br />Shores. <br />B. Conditional Use Permit. <br />Shortly after the 1983 Joint Use Dock License was issued, owner Charles J. Maciosek <br />and new buyer H. Richard Zuckman jointly applied for a CUP to upgrade from seasonal rental <br />to full year renul status for the resort. CUP review discussions included concerns that since use <br />of the property is very intense compared to the half-acre single family residential zoning, if any <br />of the 7 residential structures becomes uninhabitable, they should be tom down immediately. <br />A phasing out of the rental use over time was discussed at length but ultimately not adopted. <br />The only limit on boats discussed in the CUP resolution was to limit boat storage on land to 3 <br />fishing boats less than 16’ in length. <br />Council may wish to review the memos and minutes leading to issuance of the initial joint <br />use dock license and CUP in 1983. <br />C. 1991-1994 Joint Use Dock License Reviews <br />In reviewing the 1991 joint use dock license application, the City anticipated removal of <br />1 or more cabins due to deteriorating condition, and for the first time added a third condition
