4. The Council finds that granting a conditional use permit to allow the temporary’ <br />installation of a greenhouse on the property will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring properties, nor will its use <br />depreciate surrounding property values and that the proposed level of use of the <br />property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning Code Section 10.28, Subdivision 3 (A) to <br />permit the temporary use of a 14 ’ x 60 ’ greenhouse at a maximum height of 10 ’ on the property <br />located at 120 Golden View Drive, subject to the following conditions: <br />1. The temporary greenhouse shall be installed on the property from March 25, <br />1994 through June 15, 1994. When the structure is dismantled, the greenhouse <br />structure shall be stored off-site. <br />2. The applicant and owner, John Hallson, shall be responsible for all activities <br />approved under the conditional use permit for the use of Common Harvest <br />Community Farm. <br />3. John Hallson, the owner of the property, is hereby advised of the potential for <br />eliminating suitable septic areas on the property because of the use of heavy <br />equipment compacting soils. The existing and alternate septic sites that cuirently <br />serve the residence on the property must be staked prior to the installation of <br />greenhouse or any other land alterations. <br />4. The temporary greenhouse structure shall be installed to meet all required <br />standards of the State Building and Fire Codes. <br />Page 2 of 4
