A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PERMUNICIP L ZONING CODE <br />SECTION 10.28, SUBDIVISION 3 (A) <br />FILE NO. 1902 <br />WHEREAS, Dan R. Guenthner (hereinafter the "applicant") has an interest in <br />the property located at 120 Golden View Drive within the City of Orono (hereinafter "City") and <br />legally described as: <br />Lot 2, Block 1. Hallson Estates, Hennepin County, Minnesota (hereinafter <br />"property"); and <br />WHEREAS, the applicant has applied to the City of Orono for a conditional use <br />permit to permit the temporary use of a greenhouse from March 25 through June 15, 1994 per <br />Municipal Zoning Code Section 10.28, Subdivi>ion 3 (A). <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #1902. <br />2. <br />3. <br />The property is located in the RR-IB Rural Residential Zoning District requiring <br />two acres in area. The subject property consists of 8.6 acres. <br />On February 22, 1994 the Orono Planning Commission reviewed the application <br />and recommended approval of the application as proposed based on the following <br />finuitigs: <br />a.The structure shall be in use no more than three months out of the year. <br />b. When the structure is not in use, it shall be dismantled and stored off-site. <br />c. The temporary accessory structure shall meet all required setbacks of the <br />RR-IB zoning district and oversized accessory structure code. <br />Page 1 of 4
