5.The City Couai 4S considered this application including die findings and <br />reconunendations of the Planning Commission, reports by City statf, comments <br />by the applicants and the effect uf the proposed vanance on the health, safety and <br />welfare of the community. <br />CONCl: SIONS. ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Mumcipal Zoning Code Section 10.22, Subdivisions I (B) and 2 to permit <br />tiic construction of an addition to the lakeside of the existing residence to be located 8’ in tront <br />of the average lakeshore setback line and will result in 6,017.3 s.f. or 32.2% total hardcover <br />resulting in a variance of 1,359 s.f. or 7.29%, subject to the following conditions: <br />All hardcover improvements scheduled tor removal shall be completed prior to <br />the final inspection by the Orono Building statf for the new construction. <br />Hardcover removals shall include the following numerically keyed improvements <br />as sh<iwn on Page 6 ot this resolution: 6, 10, ll, 12, and 13. <br />Authorities granted by this variance run with the property not with the applicants, <br />but arc permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />e.xpire on that date (February 28, 1995). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants nave read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />Page 3 of 6
