Request for Council Action continued <br />page 2 of 2 <br />February 9. 1994 <br />Zoning File #1896 <br />5.It is impossible to make any hardcover removals of the existing improvements <br />within the rear yard portion of the property because of the layout of the house and <br />sloping topography, the easement to the east, the treed higher elevations to the <br />west and the street to the south. It is difficult to make any changes in retaining <br />walls adjacent to driveway areas because of the potential of erosion and <br />undermining of driveway area. <br />The Planning Commission accepted the hardships but felt because of the size of the two story <br />addition and the fact that removals consist of nonstrucmral hardcover that hardcover remain at <br />the existing level of 31.1%. Please review the minutes of the January 18, 1994 meeting for <br />more background on the discussion of that review. Members did ask the applicants to consider <br />the removal of specific improvements but each was found to have a major impact on existing <br />elevations or use of the limited rear yard area based on the sloping topography. <br />The Planning Commission recommended unanimous approval of the proposed improvement plan <br />for the property but conditioned approval on hardcover remaining at 31.1 % within the 75-250 ’ <br />setback area and directed applicants to provide an amended hardcover removal plan for Council s <br />review. Planning Commission members further added that any improvements scheduled for <br />removal would have to be completed by the final inspection of the Building Inspector for the <br />proposed new structural improvements. <br />Please review Exhibit L, applicants’ letter of February 7th that asks that the original proposal <br />be presented for Council ’s consideration as additional hardcover removals were not acceptable <br />or feasible. The enclosed staff memo dated January 10, 1994 will provide greater detaU and <br />background on the original proposal presented to the Planning Commission. <br />Options of Action <br />Approval as proposed; or <br />Approval as amended; or <br />Denial. <br />COUNCIL A CTION REQUESTED: <br />Council is asked to provide conceptual direction to the staff so that an appropriate resolution can <br />be prepared for action by the Council at their February 28th meeting.
