LAKE MINNETONKA CONSERVATION DISTRICT <br />MEMORANDUM <br />TO: <br />FROM; <br />RE: <br />DATE: <br />LMCD MEMBER CITIES <br />BILL JOHNSTONE, CHAIR OF LMCD <br />LMCD DISSOLUTION RESOLUTION <br />JANUARY 14, 1994 <br />As many of you know, the Cities of Orono and Spring Park <br />have passed resolutions requesting the dissolution of the <br />LMCD. Several other member cities have expressed, either <br />formally or informally, their support for the continuation of <br />the LMCD. Under the LMCD's enabling legislation, Minn sota <br />Statutes, Section 103B.605, Subd. 4, the LMCD "may be <br />dissolved by a decision of the governing bodies of three- <br />quarters of the municipalities in the district." The LMCD <br />consists of 14 member cities. <br />The Board of the LMCD believes that the question of <br />dissolution needs to be resolved. Continuing uncertainty <br />with respect to this issue serves no important purpose and <br />impairs the LMCD's ability to carry-out its responsibilities. <br />If the requisite number of member cities believe that <br />dissolution is appropriate, then the decision should be made <br />and alternative arrangements for management of the lake <br />should be developed and implemented with appropriate <br />legislative approval. Alternatively, if the requisite number <br />of member cities do not favor dissolution, the Board believes <br />that this decision should be made formally and documented. <br />Members of the Board of the LMCD have discussed the <br />issue of dissolution with their respective member cities and <br />other interested persons. Based on those discussions, a <br />substantial majority of the Board supports the preservation <br />of the LMCD. At the same time, the Board is aware of the <br />concerns and criticisms of some of the member cities and <br />others and is committed to working with the cities to address <br />the criticisms and concerns in a fair and responsible manner. <br />Attached to this Memorandum is a form of resolution <br />regarding dissolution of the LMCD. The Board of the LMCD <br />requests that the city council of each member city that has <br />not formally acted or the question of the LMCD's dissolution <br />consider the resolution as soon as is convenient. If your <br />city has taken formal official action on the question of <br />dissolution, please send a certified copy of the action to <br />the LMCD's offices for filing.
