City Administrator <br />January 19, 1994 <br />.4 <br />SUBJECT: Use of Drug Forfeiture Funds <br />% <br />Background <br />State law allows the polke to seize money and property that is related to violations ot drug laws. <br />When the Court awards the nwney to the police, the County AKomey receives 20%, the State <br />receives 10% and the police department may retain 70% to be used for specific law enforcement <br />purposes. <br />The money may be used as “buy money" for »Jditional enforcement, it may used to pay salaries <br />for extra drug enforcement, it may be used for other drag enforcement or drug abuse prevention <br />efforts, or it may be used for other general law enforcement purposes. <br />During the past two years the only drug money used by the police department has been for "buy <br />money" for drug dealing investigation. The current balance in the drug forfeiture fund is <br />$10,3*98.58. An additional $4,489.10 will be added to this fund in the first part of 1994, <br />bringing the total to $14,887.68. <br />A policy and procedure is needed to provide guidelines for how the drug forfeiture money may <br />be used and how its use is authorized. <br />Proposed Policy and Procedure Regarding the Use of Drug Forfeiture Funds <br />Policy; Drug forfeiture funds may be used tor law enforcement purposes including; "biy <br />money" for drug investigation, expenses related to extra drug enforcement such as police officer <br />salaries, other drug enforcement or drug abuse prevention efforts, minor capital itenK that are <br />beyond the funding able to be provided through the regular budget, and other law enforcement <br />related purposes. <br />Procedure: In the case of "buy money" for drug investigations, drug forfeimre funds may be <br />used at the discretion of the Police Chief . In the case of all other uses, the request for the <br />expenditure of drug forfeiture funds must be approved by the City Administrator and authorized <br />by the City CoutKil. <br />Council Action Requested - Motion to approve the proposed policy and procedure regarding the <br />expenditure of drug forfeiture money. <br />1
