The City claimed it was an <br />error based on current information discovered in the third <br />review. If you review yo’ir PRD and the LR-lC-l sections of the <br />code, you will find no cx^ar direction to the City regarding PRD <br />density credits. The variance was granted based on the fact that <br />the applicant had dedicated for public roads some 1.39 acres in <br />area. The retention pond within pads 6 & 7 was also not included <br />in the net area. <br />Twin homes have failed to sell. There has been no interest In <br />building on the remaining 12 pads in the last 4 years. <br />Current Proposal - Review Exhibit C <br />Mr. Haugen seeks permission to put single family detached homes <br />on the remaining vacant pads (refer to Exhibit B). Each single <br />family residence can easily meet the required setbacks of the LR- <br />IC zoning district of 30' front and rear, and 10' side. Staff <br />has advised the applicant that in order to build single family <br />residential units within the Navarro plat, the applicant would <br />have to file a formal conditional use permit to amend the <br />original PRD mode of development. The LR-lC-1 density credit <br />would no longer apply. Upon approval of a conditional use permit <br />that would amend the PRD, the only other technical legal step the <br />applicant would have to take would be to combine each pair of <br />pads prior to the issuance of a building permit or more <br />appropriate upon approval of the PRD. Applicant is aware that 24 <br />sewer and water assessment units have been paid against the <br />property already. Applicant does not claim to seek any credit <br />for the additional units not used - applicant has not paid the <br />special assessments, the current owner (the bank) has paid all <br />special assessments against the property. <br />Current PRD Proposal - Density Credit - <br />12 existing units + 7 new units ^ 19 total units <br />PRD under LR-IC Zoning - <br />Required « 9.5 acres, 413,820 s.f. <br />Proposed « 7.8 acres, 342,846 s.f. <br />Variance = 1.7 acres, 70,974 s.f. <br />Undeveloped area = 3.8 acres, 169,479 s.f.(include area of <br />drainage easements within pads 6 & 7 as density credit of LR-IC- <br />1 is no longer applicable). <br />Existing 12 units under the LR-lC-1 mode: <br />Required <= 4 acres, 174,240 s.f. <br />Existing = 4 acres, 174,240 s.f. <br />New 7 units: <br />Require = 3.5 acres <br />Remaining undeveloped land 3.8 acres <br />pm
