Zoning File #1481 <br />November 17» 1969 <br />Page 2 of 3 <br />4.In conjunction with lowering that culvert, applicant also <br />regraded the swale in the 0-75' zone to accommodate drainage <br />away from the walk-out door which was constructed to the <br />basement area. This walk-out door was approved by the <br />building inspector on the ronodeling plan, but no indication <br />of site grading to accommodate that door was submitted. <br />Staff had no Indication that the applicant intended to lower <br />the grade between the door and the shoreline. A door well <br />could easily have been constructed to accommodate that <br />doorway without the need for grading in the 0-75' zone. <br />5.The applicant notes that as part of the original subdivision <br />to create this lot, a swale along the west lot line was <br />required and had been installed in 1975. The grade at the <br />wall in the location of the basement doorway previously was <br />approximately 3* higher and the swale just continued along <br />the west side of the house from the front yard out to the <br />lake. <br />It is staff's opinion that the reduction in grade in the 0- <br />75* within 20' of the shoreline is necessary for drainage <br />maintenance. Any grading work from 20* to the house doorway <br />(about 100* back from the shoreline) was not necessary <br />except to provide gravity drainage away from the basement <br />door. <br />Discassion - <br />Except for the area of the swale, the lakeshore yard has <br />been restored back to original grades, i.e. the temporary storage <br />fill has been removed and the ruts created by the trucks carrying <br />rip rap boulders, have been refilled and top-dressed. The <br />questions posed to the Planning Commission are two-fold: <br />A) Should a conditional use permit be granted after-the- <br />fact for grading work within 20' of the shoreline to <br />maintain the culvert through the rip rap and the swale, <br />which were required as part of the 1975 subdivision? <br />B) Should the additional depth of swale be allowed to <br />accommodate the basement doorway, or should that area be <br />restored to pre-existing grades and some sort of well/step <br />system be constructed for the doorway, totally in the 75- <br />250' zone? <br />The grade at the basement doorway has been dropped <br />approximately 3*. In the 0-75' zone, the lowering of the grade <br />at the bottom of the swale ranges from just a few inches to <br />approximately 12 Inches to 18 inches at the 75* setback line.
