FILE #LA23-000050 <br />October 16, 2023 <br />Page 6 of 6 <br /> <br /> <br /> <br />The neighboring property owner at 3365 Crystal Bay Road has submitted a comment letter (Exhibit I). The <br />neighboring property owner is not supportive of the project due to the impact on his current view of the <br />lake and the additional hardcover. The applicant has moved the house further from the lake after speaking <br />with the neighbor, which is reflected on the current proposal. <br /> <br />Issues for Consideration <br />1. Does the Planning Commission find that that the property owner proposes to use the property <br />in a reasonable manner which is not permitted by an official control? <br />2. Does the Commission should discuss the increase in hardcover and request the hardcover <br />calculation specific to the area within the 75 -foot setback. Testimony from the applicant <br />regarding mitigation for stormwater should be requested. <br />3. Are there any other issues or concerns with the proposed rear yard setback as it relates to the <br />HCRRA property? <br />4. The Commission should inquire about the construction timeline of the project and how the <br />applicant plans to manage construction parking on Crystal Bay Road. <br /> <br />Planning Staff Recommendation <br />Staff is supportive of the requested variances for lot area, lot width, 75-foot lake setback, hardcover within <br />the lake setback, overall hardcover, and rear yard setback in order to construct a new single-family home <br />with the following conditions: <br />1. The property cannot use HCRRA corridor for any personal improvements. <br />2. Pervious pavers or similar material must be used for any walkways or patios. <br />3.
