This application is regarding preliminary plat approval to combine 5 separate PIDs into <br />two buildable lots. <br /> <br />2. MN§15.99 Application Deadline. The application was received on October 24, 2022 and <br />considered to be complete on September 25, 2023. Therefore the 120-Day review period expires on <br />January 23, 2024. <br /> <br />3. Background/ Summary. The owner is requesting preliminary plat approval to combine 5 separate <br />PIDs into two buildable lots. The combined area of the lots is 5.13 acres (223,462 square feet). The <br />properties are located within the RR-1B one-family rural residential zoning district. This application is <br />not a subdivision. Normally this action <br />could be completed as an administrative <br />boundary line adjustment (subdivision <br />exception); however, due to the need to <br />formally change the status of two of the <br />parcels which are currently classified as <br />“outlots”, a plat is required. <br /> <br />The property owner intends to maintain <br />their existing residence and <br />improvements on proposed Lot 1. <br />Development of Lot 2 has not been <br />proposed at this time. <br /> <br />4. Project Description. The wooded <br />site includes a small drainage creek <br />which the property owner is planning to reorient slightly. Work began on the drainage creek in the Fall of <br />2022 without proper City permits. The work was stopped and the owner has been working with City Staff <br />as well as other regulatory jurisdictions (DNR, USACE, and MCWD) to complete the project through <br />permitting. <br /> <br />5. Planning Commission Vote and Comment. On October 16, 2023, the Planning Commission held a <br />public hearing. The majority of the comments received from the public were focused on the grading work <br />in the drainage ditch and the downstream impacts. Following the public hearing, the Planning <br />Commission voted 6 to 0 on a motion for approval of the preliminary plat in accordance with the Staff <br />recommendation. <br /> <br />6. Public Comment. Written comments from the public were received as well as testimony during the <br />public hearing. The comments were focused on the erosion from the unpermitted land alteration activity <br />and downstream sedimentation which resulted from the unprotected ditch. The draft planning <br />commission minutes are attached as well as the submitted written comments, as Exhibits D and E. <br /> <br />7. Request for Materials.
