PILE #1142 n 'WHEREAS, Smith's Bay Marina, Inc. (hereinafter "the applicant has an interest in the property located at 1955 Shoreline Drive within the City of Orono (hereinafter "City") and legally described as follows: Commencing at the intersection of the North line of Central Avenue extended Easterly with Easterly right-of-way line of County Road No. J thence Northeasterly 42 degrees 15 minutes East 120.05 feet to actual point of beginning thence South 57 degrees 45 minutes East 29.04 fee- thence North 37 degrees 50 minutes East 130 feet to the intersectio: of North line of Grand Avenue extended Easterly thence North 5. degrees 45 minutes West 18 feet thence Southwesterly 42 degrees Ir minutes West 131.05 feet to beginning including accretions, "ORA PARK ON LAKE MINNETONKA", Hennepin County, Minnesota, (hereinafter "th- property"); and WHEREAS, the applicant proposes the construction of a principa structure and major restoration of the marina property and has applied t the City for variances to Municipal Zoning Code Sections 10.22, Subdivisic 1 to permit fencing 10 feet from the lakeshore instead of the required 7 feet, 10.41, Subdivision 5 (A) to permit parking stalls for 42 vehicle instead of the required 48 stalls. Section 10.41, Subdivision 9 to permi parking 10 feet from the street lot line instead of the required 30 feet Section 10.41, Subdivision 10 (A) to permit the principal structure to b built 50 feet from the shoreline instead of the required 75 feet Subdivision 10 (B) to permit the principal structure to be built 40 fee from the side lot line adjacent to a residential zone instead of th required 50 feet. Subdivision 10 (D) to permit 15,862 s.f. or 63.4% c hardcover (actual reduction of 10% over existing hardcover at 73.6%) withi 75 feet of the lake where no hardcover is allowed and to permit hardcove to remain at 5,100 s.f. or 300% over the allowed amount of hardcover a 1,275 s.f. or 25% and per Section 10.41, Subdivision 2 seeks approval of commerical site plan for the complete restoration of a marina property.
