Trior to 3 years ago, the <br />property was used for a commercial/retail use. The use was severely <br />limited and many of the businesses failed. *^3 a non-conforming <br />use, once the use ceases for a period of 12 months, the use of the <br />property must return back to a conforming use. <br />The applicant proposes a comprehensive child care center <br />consisting of pre-school age children aged 2-1/2 through school age <br />operating 6:00 a.m. to 6:00 p.m., Monday through Friday. The <br />applicant seeks approval for a total of 60 children enrollment. <br />Based on the current capacity of the facility, the first phase of <br />the operation will be limited to 29 consisting of both students and <br />teachers. At the time the facility serves more than 29, a <br />sprinkler system and new well will be installed. The new well must <br />be installed to the west side of the property or close to the <br />principal structure providing a minimum 75' separation for future <br />septic drainfield area to east side of property. Refer to Exhibit <br />J. <br />Per Weckman's memo, the current septic system can serve total <br />of 30 student/teacher use level. Refer to Exhibits E and F. <br />Weckman's memo reaffirms there is adequate area to serve a day care <br />facility at a maximum 60 student enrollment. <br />Gustafson, of the City Engineer's office, recommends a new <br />parking layout reducing the proposed 10 spaces to required 0 and <br />providing adequate area for a service lane to allow quick in and <br />out movements from property. Refer to Exhibits H-1-2. <br />Refer to Exhibit J. The curb cut shown at Highway 12 has been <br />removed. The current access drive in use v-as to have been <br />abandoned. The Engineer recommends that the proposed entrance to <br />the east side of property and new drive be installed. Portions of <br />the access drive will encroach within County right-of-way. There
