Charles Nolan, Jr. and Janice Berg The following represented the <br />City Stali'; Building and Zoning Administrator Jeanne Mahusih, .Assistant Planning and <br />Zoning .Administrator Michael Galfron. and Recorder Sherry Frost Mayor Edward <br />Callahan. GA.MBLE, ML, 4680 BAVSIDL ROAD - PRELIMINARY <br />SCBIDIVISION - PI BLIC HEARING - 7:00-7:25 P..M. <br />The Certificate of Mailing and .Affidavit of Publication were noted. <br />Donald Peterson represented the applicant <br />Mabusih reponed this proposal is to divide Outlet C of the Painters Creek Planned <br />Residential Subdivision, the remaining open space, Outiot D, from the former Ski Tonka <br />property. The properiv is bounded by County Road S4 on the south and McCulley Road <br />on the west Tlie 13 3S acre property is to be divided into two lots in the five acre <br />minimum lot zone I he lots do not meet the required lot width ot 100' to the rear ol the <br />300 ’ front street .setback l.ot 1 is defined as a comer lot and the code.would define the <br />front yard at CoRd 84, where there is limited lot width along the south lot line. Lot 2's <br />front yard is al.so adjacent to CoRd 84 and has limited lot width to the south ot the lot. <br />There are suitable sites for septic treatment on both lots The proposed building site on <br />Lot 2 does not conform to reijuired rear yard setback The structure must be moved 60 ’ <br />south to conform to the 100 ’ setback. The proposed building site on Lot I meets all <br />rei]uired setbacks. <br />Access is the main issue The proposed driveway has not yet been shown. There is a <br />.safety concern because of a hill at CoRd 84 Staff recommends access at west side of lot <br />2. Mabusth noted that these lots are in the VVestonka School District, as lots in the <br />Painters Creek PRl^ to ea.st are in the Orono School District. <br />,\lr. Peterson said the building pad was incorrectly shown. Mabusth asked Mr Peterson <br />about the bam on Lot 2 which is not readily seen. Mr. Peterson said he will get a <br />demolition permit and remove the bam. <br />The prospective buyer of Lot 2 confirmed his concern with the rear lot line and asked for <br />clarification from the commission whether the north lot line is really a side yard. Start will <br />work with this prospective buyer to address any questions concerning placement ot <br />residence.
