MN 55404 <br />TYPE OF APPLICATION:Variance/Condiiional Use Permit <br />DATE OF MEETLNG: 8/15/94 VOTE: — FOR AGALNST <br />• Applicants indicated they would withdraw the application and resubmit with Frank <br />Kokesh as applicant. <br />• Applicant ’s attorney indicated he would research the legal issues sunounding issuance <br />of a CUP to a non-owner and/or the ability of an owner to transfer CUP <br />rights/obligations to a non-owner. <br />• Planning Commission requested that staff ask City Attorney to also review this, and for <br />staff to review any similar situations currently existing in the City. <br />• Zoning Administrator Jeanne Mabusth has concluded that the current application signed <br />by Ms. Harmon as applicant and by Mr. Kokesh as owner need not be formally <br />withdrawn nor re-submitted, but that additional inlormation from the applicants is <br />required: <br />1. Applicant to provide a to-scale plan using the 1988 survey to detine areas to be <br />used in her horse boarding/riding academy operation. Application cannot be <br />scheduled for funher Plamiing Commission review until a to-scale site plan is <br />submitted for staffs review. <br />2. Staff is advised that the property is tor sale. Given this intormation, do <br />applicants wish to proceed with this request? If a buyer for the propeny is found, <br />will the horse operation continue? <br />Applicant ’s ne.xt scheduled meeting is dependent upon receipt of additional information. <br />Deadline for the September 19th meeting is September 9th. <br />If the applicant has trouble obtaining additional information, please contact the Zoning <br />Department (473-7357). <br />If you desire certified copies of the official Planning Commission minutes, they are avaUable <br />from the City Recorder after review and approval by the Planning Commission. <br />ch
