Zoning File #1942 <br />July 13, 1994 <br />Page 2 <br />Descfiption of Request <br />Applicant has filed for a conditional use permit to permit the continued use of finished <br />living space above a detached garage as a guest house/apartmeni use. The City has no record <br />of approving a guest house use for this structure. The structure currently consists of two <br />finished rooms. The structure has never been connected to municipal water or to sewer. Refer <br />to Exhibit G. Applicant proposes the installation of a bathroom and kitchen area within the <br />existing building envelope. No expansion of the existing structure is proposed. <br />The detached structure is structurally sound. It is staffs understanding that the structure <br />will be re-sided with similar siding proposed for principal structure. New windows will be <br />installed. <br />The structure is located 3’ 1" from the side lot line. The City Building staff will inspect <br />the structure to ensure that appropriate fue wall separation is provided from lower level garage <br />to upper level residential unit. Upon your site inspection, note the proximity of accessory <br />structures on lot to the west. The Building Inspector has confirmed that fire wall construction <br />will not be required as a 3’ minimum setback is maintained from lot line. <br />The structure has served the occupants of the principal struemre as either sleeping rooms <br />or additional recreational living space in former years. As there is not enough area to permit <br />a future subdivision of this property, it may not be necessary to determine if there is adequate <br />separation between the two structures, although 62’ separation does exist providing adequate <br />room for a division line. <br />If a conditional use permit is granted and sewer and municipal water is provided to the <br />structure, applicant will be responsible for payment of a sewer and water connection fee as <br />follows: <br />Sewer unit - Based on 1994 Fee Schedule = $1708.10 <br />Water Unit - Based on 1994 Fee Schedule = $1933.00 <br />It will also be the applicant’s responsibility to provide approved service lines to guest house <br />struemre. Refer to Exhibits H, I and J. The guest house may be served by existing sewer line. <br />Note additional water or sewer smbs were not provided to this property (sewer 1964, water <br />1970). <br />Issues for Consideration <br />1.The property can never be subdivided because of the area limitations, would Planning <br />Commission members recommend the granting of an area variance of 16% to allow guest <br />house use?
