Tiie wetland is a designated <br />wetland and falls under th-. protective covenants of the City Code. The application <br />involves not only the conditional use permit required for the excavation but a <br />variance to the Code that would prohibit grading and filling within a wetland. <br />Pertinent Ordinances <br />A. Section 10.55. Subdivision 8 - Prohibition. Tlie Ctxie specifically prohibits land alterations <br />within w'etlands and within 26' ol the boundaries of those wetlands.
