Tiie wetland is a designated <br />wetland and falls under th-. protective covenants of the City Code. The application <br />involves not only the conditional use permit required for the excavation but a <br />variance to the Code that would prohibit grading and filling within a wetland. <br />Pertinent Ordinances <br />A. Section 10.55. Subdivision 8 - Prohibition. Tlie Ctxie specifically prohibits land alterations <br />within w'etlands and within 26' ol the boundaries of those wetlands. Applicant proposes <br />e.xcavation and grading within the vseiland. <br />B.Section 10.56, Subdivision 16 (J), 5 (A) (1-6) - Grading or filling in Types 2, 3.4, 5,6, 7 and <br />8 wetlands must be e\aluated to determine how e.\tcnsively the proposed activitv would <br />alfect die follow ing functional qualities of the wetland: <br />1. <br />■y <br />3. <br />4. <br />5. <br />6. <br />Sediment and pollutant trapping and retention; <br />Storage of surface runoff to prevent or reduce flood damage; <br />Fish and wildlife habitat; <br />Recreational use; <br />Shoreline or han't stabilization; <br />Noteworthiness, including special qualities such as historic significance, critical <br />habitat for endangered plants and animals, or other. <br />Tlie applicant has applied to the Watershed District for a permit and Corps of Engineers has <br />been asked to review the project. <br />C .
