TRANSPORTATION EMPLOYEE DRUG AND ALCOHOL POLICY UNDER <br />THE OMNIBUS TRANSPORTATION EMPLOYEE TESTING ACT Continued <br />F. The distribution or sale of Drugs including, making arrangements during working <br />time or on City property for the sale, purchase, or transfer of Drugs is strictly <br />prohibited, even if the actual sale, purchase, or transfer of Drugs occurs during <br />non-working time or off City property. <br />G. All employees must notify the City Administrator of any criminal drug statute <br />Conviction for a drug law violation occurring in the workplace. The notice must <br />be given to the City no later than five (5) days after the Conviction. <br />H. Any employee found to be in violation of this polic / is subject to discipline up <br />to and including termination of employment. <br />COYTRAGE <br />The Omnibus Transportation Employee Testing Act require that all employees whose Job duties <br />include operating a commercial motor vehicle and who are required to hold a commercial <br />driver ’s license shall be subject to drug and alcohol testing. "Commercial Motor Vehicle" <br />(CMV) means a motor vehicle or combination of motor vehicles used to transport passengers <br />or property if the motor vehicle meets any one of the following criteria. <br />A. Has a gross combination rating of 26,001 or more pounds inclusive of a towed <br />unit with a gross vehicle weight rating of more that 10,000 pounds; or <br />B. Has a gross vehicle weight rating of 26,001 or more pounds; or <br />C. Designed to transport 16 or more passengers including the driver; or <br />D. Is of anv size and is used in the transportation of materials found to be hazardous <br />for the purposes of the Hazardous Materials Transportation Act and which require <br />the motor vehicle to be placarded. <br />All applicants, including persons currently employed the City of Orono, that apply for a position <br />where job duties include operating commercial motor vehicles will be required to take a drug <br />and alcohol test if a job otfer is made. <br />DEFINITIONS <br />1.Accident means an occurrence involving a CMV operating on a public road which results <br />in:
