CITY OF ORONO <br />TRANSPORTATION EMPLOYEE DRUG AND ALCOHOL POLICY UNDER <br />THE OMNIBUS TRANSPORTATION EMPLOYEE TESTING ACT <br />The abuse of drugs and alcohol is a nationwide problem which affects persons of ever>' age, race <br />and gender. The City of Orono recognizes that work performance and safety problems are <br />created when employees use or abuse illegal drugs and/or alcohol. The City of Orono wishes <br />to provide a safe work place for its employees and to maintain a drug and alcohol free work <br />place. The City of Orono has established the following policy on drugs and alcohol with drug <br />and alcohol testing provisions mandated by the Omnibus Transportation Employee Testing Act <br />of 1991. <br />POLICY AND RULES <br />A. All employees are strictly prohibited from using, possessing, selling, transferring, <br />or being under the influence of drugs or alcuhol while working or performing job <br />duties or while on the City of Orono premises or while operating the City of <br />Orono’s vehicles, machinery or equipment. "Drugs” are defined as any <br />controlled substance. <br />B. No employee shall perform safety-sensitive functions within four hours after using <br />alcohol. <br />C. No employee shall report for duty or remain On Duty when he or she uses any <br />Controlled Substances, except when the use is pursuant to the instruction of a <br />physician who has advised the employee that the substance does not adversely <br />affect the employee's ability to safely operate a commercial motor vehicle. <br />D. Any employee using a prescription drug which could potentially affect safety or <br />the employee’s performance must immediately notify his or her supervisor of the <br />drug the employee is taking, the name and address of the doctor prescribing the <br />drug, and length of time the employee will be taking the drug. The supervisor <br />will immediately notify the MRO. When in the MRO’s opinion, after <br />consultation with the prescribing physician, the employee’s use of the drug will <br />impair the employee’s job performance or will create a threat to the safety of the <br />employee or others, the employee will be deemed medically unqualified to <br />operate a commercial motor vehicle. The City will work with the employee to <br />determine if there is a suitable temporary job alternative. <br />E. No employee shall report for or remain On Duty if the employee tests Positive <br />for Controlled Substances.
