rc <br />Request for Council Action continued <br />Page 2 <br />November 2, 1995 <br />Zoning File #2031 Bruce Kelley, 2340 Fox Street <br />The applicant has been made aware of Section 11.03, Subdivision 24 (Lot Area, Minimum). <br />The future owner of proposed Lot 2 at 4 acres shall be placed on notice as to the Code <br />requirements concerning the exclusion of driveway easements from total lot area. <br />Sc'.tic systems have been approved for both parcels. The current system serv ing the residence <br />on proposed Lot 2 is located within Lot 1. The system is non-conforming and must be <br />replaced. The failing system must be abandoned prior to the City’s issuance ot a Certificate <br />of Occupancy for the new residence on Lot 1. It is the applicant's plan to live m the residence <br />on Lot 2 while their new home is constructed on Lot 1. The future owner or purchaser ot Lot <br />'> must be advised of the need to install a new septic system prior to occupancy. The <br />resolution granting approval of Uie plat shall define the obligation of the applicant concerning <br />the need to abandon the existing septic system on Lot 1 and providing notice to future owner <br />of Lot 2 of need to install new septic system prior to occupancy. <br />The Park Commission reviewed the subdivision application on August 7th and have asked for <br />a park dedication fee. The Assessor wi” be asked to determine the fair market value of the <br />undeveloped land based on 8°o of the total area within Lot 1 only. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the preliminary subdivision <br />of Lot 2, Block 1. Bill Kelley's Land, finding all standards of the RR-IB Zoning District, On- <br />Site Septic Code and pertinent sections of the Subdivision Regulations have been satisfied. <br />Their approval was based on the following conditions: <br />1.Applicant to grant 10’ drainage and utility easements along the perimeter of the <br />property and 5’ drainage and utility easements along internal lot lines on the <br />final plat. <br />2 Payment of a park dedication fee based on 8% of the fair market value of the <br />two acre parcel. Lot I, as homestead parcel would not be subject to the park <br />dedication fee. <br />Applicant and owner of Lot 1 will be responsible for abandoning the existing <br />septic system within Lot 1 prior to the City's issuance of a Certificate of <br />Occupancy for the new residence. <br />4.Notice to future buyer or owner of Lot 2 of need to install new septic system <br />on Lot 2 prior to occupancy.
