'A <br />5. <br />6. <br />7. <br />8. <br />9. <br />Subdivider has created private covenants dealing with the upkeep and maintenance <br />of all drainage facilities and fwotectiv^ covenants for all lots containing wetlands not <br />included within conservation maps of the City of Orono. The covenants shall include <br />metes and bounds descriptions of the protected areas and a site plan locating these <br />protected areas within each of the involved lots. <br />Subdivider has executed a Developer’s Agreement providing for the installation of <br />certain improvements as a condition ot subdivision approval. Subdivider has also <br />provided a letter of credit written to 150% of the cost of these required <br />improvements. <br />Subdivider has created private covenants providing special buffer or conservation <br />areas 50* along exterior lot lines, 30' in width along internal lot lines and 30' in width <br />on each side of the shared driveways within French Creek Woods. Covenants would <br />restrict all land alterations and the removal of trees 2" or more in diameter at 4‘ above <br />the ground unless the trees are dead, diseased or a hazard without first obtaining the <br />written consent of the City of Orono. Covenants shall include a map locating the <br />special buffer/conservation areas as they impact each lot in the subdivision. <br />Execution of an Easement Agreement establishing the obligation ot all residential <br />property owners benefitting tfom the use of the City's private driveway located to the <br />immediate south of French Creek Woods. Lots 3 and 4. Block 1, French Creek <br />Woods shall be served by a single shared drive. <br />Subdivider has provided written confirmation from the State Health Department that <br />the well on Lot 1 has been abandoned. <br />Payment to the City for the legal review and filing of the plat, easements and <br />covenants in the amount of $200.00. <br />11 Payment to the City of final plat application in the amount of S175.00. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of <br />Orono hereby approves the plat of French Creek Woods, Hennepin County, Minnesota, subject to <br />the following conditions: <br />1.Erosion control shall be maintained over all disturbed areas until natural ground <br />cover is restored. <br />Page 2 of3
