Request for Council Action continued <br />page 4 of 5 <br />November 9, 1995 <br />Zoning File #2074 <br />applicants were encouraged to consider a more pemianent solution but applicants adv ised that they <br />would lose their only bit of sand shoreline with riprap and that there was not enough depth from the <br />shoreline to the lakeside of the residence to allow for the alteration of the bank. At a 3:1 slope the <br />majority of the lakeshorc yard w ould be lost. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the conditional use permit and <br />variance required for the installation of the 2' timber wall. Approval was conditioned on the <br />placement of silt fence along the shoreline during the period of construction until all disturbed areas <br />are restored and that the timber wall be installed with treated timber. Mr. Richter of the DNR has <br />asked if the impact of the structure could be minimized by requiring plantings at possibly the top of <br />this bank to minimize the visual impact from the public waters. <br />Conditional Use Permit/Variance - Installation of Accessory Structure/Garage <br />The proposed 25'x30' accessory structure will require no setback variances. There is no excessive <br />hardcover within the 75-250' setback area nor will structural coverage excesses result from the <br />improvement. Hardcover in the 0-75 ’ setback area exists at 24.2. Applicant proposes no reduction <br />of hardcover improvements within the 0-75' setback area (855 s.f. = house and steps, 52 s.f. <br />vvalkwav). The only approvals required for the installation of the accessory structure is the <br />prohibition and conditional use pennit required for placement of structures within the floodplain of <br />Lake Minnetonka, review Exhibit Q. Approximately a third to a half of the garage structure will be <br />located below the 931.5 elevation and a small portion of the drive. Review Exhibit R, the <br />Watershed District will ask for a matching excav ation to olTset the filling of approximately 14.8 <br />cubic yards of filling will take place within the floodplain. Refer to Exhibit Q, applicants propose <br />the excavation of a swale along the north side lot line (10'xl50 ’) that will take drainage to a drainage <br />tile to be installed within the Tom Palm property to the immediate north. <br />Rev iew Exhibit M, the topographic map that defines the local watershed and existing drainagevvay <br />within neighborhood. The majority of runoff from the properties along Concordia drain to this <br />property and the Palm property to the immediate north that contains a drainage swale along Palm’s <br />north lot line that ev entually drains to West Arm. Representatives of the City have diseussed this <br />matter with both Mr. Palm and Mr. Gehring. Both property owners are willing to cooperate in <br />constructing the proposed drainage facilities to minimize the potential of flooding of both garage <br />structures located in the lower elevation within their street yards. It would appear the Watershed <br />District will approv e floodplain alteration as proposed at their November 9th Planning Commission <br />recommendation.
