Toles noted that tao g wou <br />upset liis plans for rebuilding on liis property this fall. <br />Gaffron asked the Commission about the issue wth creating a backlot by having an outloi <br />resulting in the Marfield property being more substandard tor setbacks and area ® <br />requested whether there is also a problem with the outlet to be owned by both N arhe <br />and Hill. Schroeder commented that he had no problem with it. <br />A letter from neichbors, the LevVs. favored approving the application providing the new <br />driveway not be closer than 15’ from the lot line and the uiilitv- easements to the^propeny <br />remain in effea. The neighbors to the west, the Luke's, also had no objection. They <br />asked that the City stipulate that no additional buildings be allowed on the site. <br />Hawn moved. Schroeder seconded, to amend the tabling motion to an approval motion for <br />Application #2065 subject to the approval of the Fire Department. Easements are to be <br />dealt with, and the dnveway must be at least 15' from the neighboring property. <br />Gaflfron suesested it mav be inaporopriate to place the hre depanment in a position to <br />approve or'disapprove this request without tur.her Commission input. GaSron asked the <br />Commissioners to address the issues under item # 1 in the Staff memo relating to the <br />vanances requested for replamna and rededication of easements, the wetlands delineation <br />and dedication on the property, and whether special findings are adequate to dehne this as <br />a unique request as compared to other three-lot subdivtsions, or be prepared to gram <br />approval to other neighborhoods ma>dng similar requests. <br />Rowlette said she did feel there are soeciiic findings in regards to this appUcation noting <br />the existing substandard access to the Toles propem- There would be better access from <br />CoRd 51 for emergency vehicles under the proposal. <br />Hawn noted the additional finding that removal of the cul-de-sac to allow the Hills to <br />cross to their lakeshore parcel without crossing the road would be a benefit. <br />Smith asked Gafrron if he envisioned requests from many other residents of 3-pam' cul- <br />de sacs to ask for removal, is this ooening the door for similar requests. Gaffron said it <br />could be open.no a "little door", and that is the reason good findings are important here. <br />Pederson said he was concerned that the Commission was moving this applicauon roiward <br />to ‘the Council in a mess>- form and requested that it be tabled. Lindquist said some ot the <br />issues mav come back to haunt the Commission. Schoeder agreed this could happen, and <br />not only on the cul-de-sac issue, that there are many issues involved m addition to the fire <br />safety issue.
