Further, it intends <br />to provide new utility easements to accommodate NSP and Minnegasco lines as well as other <br />potential utilities. The City is gaining the perimeter drainage and utility’ easements which were <br />not granted along the interior lot lines with the original Dicon plat. Applicants must provide <br />confirmation from all utilities affected that they accept the proposed vacation-rededication of <br />easements. An easement for access to the City sewer lateral trom North Shore Drive should <br />be required. <br />Grading and Drainage <br />With the proposed grading plan, the e.xisting catch basin and storm sewer leading from the cul- <br />de-sac will no longer be necessary. The grading plan will bring some fill into the area ot the <br />cul-de-sac to provide gradual sloping lawn areas for the Hill and Toles properties, in place of <br />the cul-de-sac. The City Engineer has been provided with a copy of the grading and drainage <br />plan. Preliminaiy plat approval should be conditioned on his review and approval of those <br />plans prior to final plat approval. <br />Neighbor Request <br />Mr. Toles has agreed to locate his new driveway at least 15’ from the Levy property line to <br />the east, meeting their request tor maintaining a buffer to their property. <br />Access Policy Issue <br />Throughout this review staff has cautioned Planning Commission that this vacation/replat is <br />contrary to current City codes and policies. In the two acre zoning district under today’s codes, <br />creation of these three lots would be subject to platting a private outlot road 50’ in width, with <br />100' platted cul-de-sac. and paved to a width of 24’, with 80 paved diameter cul-de-sac, similar <br />to what currentlv exists. Planning Commission was advised of the importance of making <br />strong findings that this specific request is unique, in order that it not be precedent-setting. <br />Staff also reviewed the extent of similar situations which exist throughout the City, noting that <br />there are few identical situations but a number that are similar (see Exhibit H of 10/13/95 <br />memo). <br />Planning Commission Recommendation <br />At their October 16 meeting. Planning Commission voted 4 to 1 to recommend approval of the <br />vacation and preliminaiy plat as proposed, subject to.
