All driveway <br />casements (Frederick Street access drive and Cascu Point Road drive) have been excluded trom <br />lot area and hardcover determination. <br />Review E.xnibit D. the Planning Commission has advised the property owner tliat the City has no <br />control over trees removed out of the 0-75' setback area. The applicant is not asking for a <br />variance as new construction will conform to all pertinent sections of the Code. <br />Planning Commission Recommendation <br />The Planning Commission recommended unanimous approval of the Class 1 subdivision <br />application for Cortlen Cloutier that seeks to divide Lot 1 from Lots 3. 4 and Outlet 1 of Tillson ’s <br />Villa Carman, finding all current standards of the LR-IC Zoning District have een met and all <br />pertinent standards of the subdivision regulations tor a Class I subdivision. Approval is subject <br />to the following conditions: <br />1.Upon application for a building permit for new residence on Lot 1, applicant shall <br />make payment to the City for a sewer connection charge of SI.284.50 based on <br />current 1995 Fee Schedule plus a Service .Availability Charge of S850.00 (charge <br />of Metro Waste Control Commission). The propeny has already been a. essed <br />two water units and trunk and lateral sewer assessmerus have been paid. <br />Applicant to create easements over Lot 1 in favor of combined Lots 3 and 4. <br />Applicant's surveyor has created legal descriptions for the access easements to <br />facilitate the creation of •'.••.us over the Frederick Street driveway that intersects <br />Lot I and the main driv*- mat intersects Lot 1. <br />Disclaimer language .fted by City Attorney is to be incorporated in resolution <br />approving subdivision. <br />COUNCIL ACTION REQUESTED: <br />To either amend or adopt the enclosed approval resolution.
