Subd. 5. Curfew - Liability of Parent(s). It shall be unlawful for any parent, guardian, <br />or other adult person having authorized care, custody, or control of any juvenile under age <br />eighteen (18), to knowingly permit such juvenile to violate the provisions of Subd. 1, Subd. 2, <br />Subd. 3 or Subd. 4. <br />Subd. 6. Curfew - Liability of Proprietor. It shall be unlawful for any person operating <br />or in charge of any place of amusement, entertainment, or refreshment, or other place of <br />business, to knowingly permit any juvenile under the age of eighteen (18) years to loiter or idle <br />in such place contrary to the provisions of Subd. 1, Subd. 2, Subd. 3 or Subd 4, and such <br />person shall immediately order such juvenile to leave. If such juvenile refuses to leave such <br />place, such person shall immediately notify the Orono Police Department of the violation. <br />Subd. 7. Curfew - Exceptions. Such curfew shall not apply to any students under the <br />age of eighteen (18) years who are lawfully attending, going to or reiuming from school, church <br />or community sponsored athletic, musical or social activities or events. <br />Subd 8. Curfew - Penalties. <br />1. Any juvenile under the age of eighteen (18) years found on or in any public street, <br />avenue, alley, park, or other place, in violation of Subd. 1, Subd. 2, Subd 3 or Subd. 4. may <br />be sent or taken home or placed under proper custody by any police officer of the Orono Police <br />Department. <br />2. Any juvenile who violates the provisions of Subd. 1. Subd. 2, Subd. 3 or Subd. 4, <br />shall be deemed a juvenile offender as defined by Minnesota Statute. <br />3. Any juvenile, guardian, or other adult person(s) who violates ih. provisions of Subd. <br />5 shall be guilty of a petty misdemeanor. <br />4. Any pri'prietor and/or employee(s) vvho violates the provisions of Subd. 6 shall be <br />guilty of a petty misdemeanor. <br />This ordinance becomes effective from and after its passage and publication. <br />Passed bv the council this 23rd day of October. 1995. <br />Edward J.
