r <br />I. <br />Request for Council Action continued <br />page 2 <br />October 19, 1995 <br />John O’Sullivan, 3340 Shoreline Drive/2420 Shad>n&ood Road, Council Direction ___________ <br />The .87 acre site has obvious physical limitations with limited parking, multiple uses and <br />traffic layout or design pushed to its limit when large-sized deliveiy trucks arrive at busy <br />limes with customers for both convenience store (gas pumps) and Na\ arrc Auto. <br />Staff lias discussed the expanded food seiv ice use within the convenience store with Mr. <br />O'SulliN'an. The owner feels that we are singling his operation out, noting there have been <br />no parking problems or accidents at his facility because ot the use. In tact, he noted the <br />intensified use of the food service has happened gradually over the years without anv <br />problems or concerns voiced by the Orono staff. In my discussions with John O Sullivan, <br />I advised that I would feel more comtortable it Council was asked to provide direction on <br />this issue. <br />Based on owner ’s current level ot food serv ice use, should the owner tile tor a conditional <br />use permit? Refer to Exhibit G, Section 10.40, Subdivision 4 (C and D). <br />If Council finds the current level of food serv ice use does not require conditional use review , <br />would Council require a conditional use permit if owner installed a food serv ice pick-up <br />window'^’ <br />COUNCIL ACTION REQUESTED: <br />To provide direction to statt and owner. <br />B. 3340 Shoreline Drive - Former Site of Martin's 66 Serv ice Station <br />John O’ Sullivan and Irv Smith are the new owners of the former service station site. The <br />new owners have removed much of the equipment and material stored on the site. John <br />O'Sullivan asks that he be allowed to continue using the fenced in area for limited winter <br />storage for the 1995-96 season. His letter notes that all equipment stored must oe removed <br />by May 1. 1996. refer to E.xhibit A. <br />.As Mr. O'Sullivan notes, this use had been conducted by Martin’s, the previous owner, over <br />the years. The use will not be intensified. In fact, this will be the only use conducted on the <br />site'during the winter months until the new owners decide what new business use will be <br />installed on the B-1 zoned property. <br />.As outside storage yards are pemiitted only in a light industrial zoned district, staff advised <br />Mr O'Sullivan that we would seek Council's direction on this matter afso. <br />COUNCIL ACTION REQUESTED: <br />To provide direction to applicant «>n the temporary use of the fenced in area for outside <br />storaize of equipment and vehicles through May I, 1996.
