Mabosth
Title Building & Zoning Administrator
Administrator Reviewed Agenda Section:
Zoning
Item Description: John O’Sullivan. 3340 Shoreline Drive/2420 Shadywood Road - Council
Direction
A. 2420 Shadvwood Road - O’Sullivans/Navarre Auto Repair
Slatf seeks Council direction concerning an expansion in food service use within the
"convenience store". Review E.xhibits D. E and F. In the original layout when the store was
opened to the public, food service occupied a quarter of the store area with packaged food
and other food items such as hot dogs cooked or heated by microwav es. At the time of the
opening. Mr. O'Sullivan advised that he was required to get a license from the Health
Department as food was prepared on the premises. The food serv ice area provided heated
and refrigerated food display units and a counter against the wall that provided additional
food items. There were three or four small tables for customers' convenie^.,
ITie current food service area now tKcupies approximately half of the conv enience store. A
separate counter area has been installed within the middle also providing expresso cotTee.
Additional stool and counter area is adjacent to the center counter area. A separate cash
machine is located behind the counter area so that food service customers can make
payments at the food service counter rather than at the central cashier.
The Building Deportment does not issue permits for the relocation of internal structures or
the installation of new fixtures. In late summer, the Building Inspector stopped the
installation of a take-out food service window being installed at the northwest comer of the
facility. Refer to E.xhibit F. ITie work was stopped because a building permit had not been
issued (Code would have required a building permit for this type of window installation) and
the improv ement proposed a major change in the operation of prov iding food service. WTien
start'compared the current level of food service use with the original. statT adv ised the owner
of a need to apply for a conditional use permit tor a restaurant use. Mr. O’Sullivan has set
aside hi plans to install the food serv ice or take-out window at this time.
Review E.xhibits B and C. During the review of .Application #958 in 1987. the applicant
made the City aware of the multiple uses and services that would be provided within the
convenience store area. The City quts.ioned the need for a zoning amendment for
convenience store use with serv ice station and decided against it finding that the physical
limitations of this site and sUuidards of the B-1 Code would be adequate (refer specifically
to the section of the statf memo in Exhibit C that addressed this very issue).
