The Public Works Director has reviewed the second curb cut at the southwest comer of the propertv' and appro\ed the location and use ot a second curb cut finding an improvement in safety based on the narrowness ot Highwood Road and the number of dwelling units served by this substandard roadway. Land alterations will not involve or encroach the adjacent property to the east. The two-tiered interlocking block retaining wull located 4‘ from the west side lot line has been installed i:)er the specifications ol the manufacturer providing for the treatment of drainage to the rear of the walls. Proposed till placed within the north yard of the property will not impact the stormwater facility installed to the east. 4. The City Council finds that granting a conditional use permit to allow the excavation and filling of 20U cubic yards of soil within this property will not be detrimental to the health, safety or gen Tal welfare of the public, would not adversely atfeci light, air nor pose a fire hazaru or other danger to neighboring properties, nor will its use depreciate surrounding property values and that the proposed level of use ot the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recomm.endations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the propo.sed variance on the health, satety and welfare of the community. rONCU SIONS, ORDFR AND CONDITIONS Based upon one or more i>f the abov e findings, the Orono City Council hereby grants a conditional use permit per Municipal Zoning Code Section 10.03.
