r <br />A RESOIAJTION GRANTING <br />A CONDITIONAL LSE PERMIT <br />PER MI NTCIPAL ZONING CODE <br />SECTION 10.03. SUBDIVISION l‘> <br />FILE NO. 2041 <br />WHEREAS, Phillip M. Otto (hereinafter the '’applicant ”) is the cnsner of the property <br />located at 4116 High%\cx)d Road within the Citv of Orono (hereinal'tcr "Cit> ”) and legally desenbed <br />as follows: <br />refer to Exhibit A, attached (hereinafter "property”); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit per <br />Municipal Zoning Code Section 10.03, Subdivision 14 to permit the excavation and tilling of 200 <br />cubic yards of earth within the property. These land alterations were not authonzed under a building <br />permit issued for new residential construction. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File filOA 1 . <br />ITie property is located in the LR-l B l.akcshore Residential Zoning District requiring <br />one acre or 43.560 s.l. in area. The property consists of 16.888 s.f. or .34 acres. <br />y.On July 17, 1495 and October 16. 1945, the Orono Planning Commission reviewed <br />the applicatit>n as amended and recommended approval based on the following <br />findings: <br />a.Final grading plan and drainage facilities as approved by the City Engineer <br />have been found to have no negative impact upon the adjacent properties as <br />a result of the further excavation of the street yard and the placement ot the <br />additional fill to the side and rear viird of the residence. <br />Page I of 6
