Request for Council Action continued <br />page 3 <br />October 18. 1995 <br />Zoning File #2041 Phillip and Darcy Otto. 4116 Highwood Road <br />The perilling cf drainage within the sfect yard has been addressed by applicant placing gutters and <br />downspouts on residence. The downspouts tic into draintile aU>ng the west side and along the <br />street or south side downspouts direct drainage to a trench drain The trench drain connects to <br />a draintile that cvenruaily drains to an outlet in the rear yard. Final grades along the east side <br />yard are shown at 1 slopes. The banks will be planted with Crown Vetch and then covered and <br />staked with curlex erosion control blanket. All land alterations are kept out ot the neighboring <br />propertv' to the east. All drainage from the residence structure will he directed to the north or rear <br />of the property. <br />Review Exhibit L, Glenn Sauer, the owner of the property located at 4104 Highwood Road, <br />advised the Planning Commission that he was concerned that the additional fill being placed within <br />the watershed would have a potential impact on his property. The City Engineer was asked to <br />review' this matter and reported that the propi>sed grading would have no perceptible impact upon <br />the retention area within Mr. Sauer’s property. Mr. Sauer was copied on the City Engineer s <br />report. The City staff has heard no further trorn Mr. Sauer nor did .Mr. Sauer appear before the <br />Planning Commission at their October 16th meeting. <br />Planning Commission Recommendation <br />To approve the after-the-fact conditional use permit for Phillip and Darcy Otto for the property <br />located at 4116 Ilighwoixl Road involving land alterations not authorized under a building permit <br />for the new construction. The land alteration involved the removal and placement of <br />approximately 200 cubic yards of earth on the property, the installation of two tiered reiaimng <br />walls located approximately 4’ from the west side lot line and creation of a second curb cut on the <br />property. Approval of this conditional use permit is based on the following findings: <br />1. The final grading plan approved by the City Engineer has been found to have no <br />impact on the adjacent properties as a result of the furiher excavation of the street <br />yard and the placement of the additional fill to the side and rear of the residence. <br />2 John Gerliardson has reviewed the second curb cut and approved the location and <br />use of the second curb cut finding an improvement in safety based on the <br />narrowness of Highwood Road and the number of dwelling units served by the <br />roadway. <br />3. Land alteraiiom will not involve or encroach the adjacent property to the east. <br />4. The proposed additional fill placed within the north yard of the property will not <br />impact the stormwater facility installed to the east.
