Request tor Council Action contimicdl <br />Page 2 <br />October 6, 1995 <br />Zoning File #2049 Fred Guttormsoa Chic Dwight <br />Planning Commissioo Recommendation <br />The Planning Commission reviewed this application at their August 21 meeting and <br />recommended conditional partial approval as follows: <br />1. Approval of 8' x 24’ screen porch addition. <br />2. Approval of 8 ’ x 24’ deck above screen porch plus stairway at north end of deck (deck <br />and screen porch not to extend past southerly wall of house). <br />3.Approval of excavation along south wall of house to allow installation of walkout <br />doors, including boulder retaining wall adjacent to front stoop. <br />4. Denial of proposed low boulder walls between the house and lake. <br />The above approvals are to be conditioned on the following: <br />1. <br />3. <br />Remove grade-level wood patio portions outside of existing deck footprint (3’ x 8 ’ <br />portion of wood patio). <br />Remove small accessory building at southeast side of property. <br />Remove detached deck structure at the lakeshore (this is an existing 120 s.f. deck <br />structure located at the shoreline). <br />4. Top dress and revegetate area of old 8 ’ giavel driveway. <br />DNR Recommendation <br />In a letter from hydrologist Joe Richter received by fax on August 21. the DNR <br />recommended denial of the proposal on the basis that the proposed screen porch and deck will <br />increase the non-conformity of the house and do not conform with the Shoreland Standards. <br />Staff Recommendation <br />Stalf questions whether there is adequate hardship demonstrated for expansion of the already <br />non-conlbrming residence to a location 34’ from the lake. Replacement of the deck in kind may be <br />justifiable, but placing a substantial screen porch undemeatli it visually and practically expands the <br />bulk of the residence structure nearer the lake.
