CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above lindings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Sections 10.22, Subdivision 2 and 10.56, <br />Subdivision 16 (L) to permit the construction of a two story addition constituting additional <br />hardcover in the 75-250 ’ zone in excess of the 25% hardcover normally allowed, subject to the <br />following conditions: <br />1. <br />5. <br />Prior to footing inspection for the addition, applicants shall remove landscape bed <br />hardcover as shown on the sketch and list attached to this resolution as Exhibit <br />A. Hardcover in the 0-75 ’ zone shall be limited to 12 s.f. or 0.2%, and in the <br />75-250 ’ zone shall be limited to 5.770 s.f. or 31.7%. Applicants are advised that <br />any future proposals to add hardcover on the property will require a variance <br />application and might be approved only in conjunction with removal of equivalent <br />amounts of pre-existing hardcover. <br />The applicant shall obtain an after-the-fact building permit for the screen porch, <br />and a construction inspection shall be conducted by the inspection department. <br />Authorities granted by this variance run with the property not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (October 9, 1996). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />Page 3 of 6
