- ^ » <br />Request for Council Action continued <br />page 2 of 2 <br />October 5, 1995 <br />Zoning File #2044 <br />The previous property owner was granted variances to reconstruct the then existing deck in <br />1987. Son^ time after the deck was replaced, the previous owner constructed a permanent <br />screen porch above it without the required building permit. That screen porch meets all setback <br />requirements and is above the approved deck hardcover. Staff recommends that the enclosed <br />porch be accepted subject to an after-the-fact building permit being issued and subject to review <br />of the construction by the inspection department. <br />Planning Commission Recommendation <br />Planning Commission reviewed this application at their September 18th meeting and on a vote <br />of 6-0 recommended approval of the proposed addition subject to removal of virtually all of the <br />landscape bed hardcover on the property. Planning Commission concurred that an after-the-fact <br />building permit and construction inspection should be required. Planning Commission suggested <br />that the resolution indicate any future strucniral additions only be approved in the context ot <br />trading structural hardcover for structural hardcover. <br />Staff Recommendation <br />Staff recommends approval per the Planning Commission recommendation, except that staff <br />disagrees with the "structure for structu-e" limitation language for this specific application, <br />because the structural hardcover is only 11.1%, significantly less than the normal 15% limit. <br />A future reque.st for strucmral hardcover up to the 15% limit might be reasonably approved in <br />the future with further reductions in non-structural hardcover. This property is not "over built" <br />as compared to many other properties in Orono w'hich have not been subject to this proposed <br />limitation. Such a limitation is in staffs opinion only appropriate when lot coverage by <br />structures exceeds the 15% limit. <br />A resolution reflectinc the Planning Commission recommendation but not including the <br />"structure for structure limitation” is attached for Council approval. <br />COLNCIL ACTION REQUESTED: <br />seconded bv to adopt ResolutionProposed Motion: .Moved by _________ . __^----------- <br /># granting a hardcover variance to George Olson ot 2775 Shadywood Road tor <br />construction of an addition to the existing residence.
