A RESOLUTION APPROVING THE <br />PLAT OF LAKESIDE HEIGHTS <br />FILE NO. 1921 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted subdivision <br />regulations for the orderly, economic and safe development of land within the City; and <br />w •* <br />WHEREAS, the City ’ Council has considered the application for a subdivision by <br />Mary A. Ulrich thereinafter "the subdivider"); and <br />WHEREAS, on May 8, 1995, the City Council approved Resolution No. 3556 <br />granting preliminary approval for a plat at 1000 Loma Linda Avenue; and <br />WHERE AS, the property is located within the LR-IB Single Family Lakeshore <br />Residential Zoning District requiring a minimum of one acre of contiguous dry buildable land <br />within each newly created lot. Each of the proposed lots meets the required one acre dry <br />contiguous land area. Lot 1 being 1.27 acres in dry buildable area and Lot 2 being 1.10 acres in <br />dry buildable area; and <br />WHEREAS, the Orono Comprehensive Plan requires only 33' of right-of-way for <br />County Road 151 and therefore the City will require a 33' right-of-way dedication for County <br />Road 151 . Further, 25' of right-of-way will he dedicated on the plat for the north half of Loma <br />Linda Avenue; and <br />WHEREAS, due to the proposed dedication of right-of-way for Loma Linda <br />Avenue, the existing house within Lot 2 will remain at its existing location 33.0’ from the right- <br />of-way line where a 35.0' setback would normally be required. The Council finds it is <br />appropriate to grant a front setback variance to accommodate the existing house; and <br />WHEREAS, wetlands have been delineated in the northwesterly quadrant <br />of proposed Lot I, and a conservation and flowage easement has been granted over said w'etlands; <br />and <br />Page 1 of 4
