The project sice is in Sec. 4,
T.117 N., R. 23 U., City of Orono. Hennepin County, Minnesota,
The original development has already affected 1.76 acres of wetland.
The present proposal would excavate about 0.38 acre and might affect
approximately 1 acre of wetland.
As you have discussed with Mr. Joseph Yanta of the Regulatory Branch,
this work may be eligible for authorization under the same nationwide general
permit, although the proposal requires Interagency review to determine whether
an individual permit may be necessary. The interagency review may cake
approximately 30 days. An individual permit review may take an additional 90
CO 120 days or more. We cannot predict the result of this review or our
determination. A particular concern might be the potential drainage effect of
the excavated pond on the remainder of the approximately l-acra wetland.
It is possible that the excavation might not be authorized, but it is also
possible that it may be authorized, perhaps with special conditions, which may
Include compcnsaLiory mitigation to replace the affected . .land.
Please let us know if you wish us to proceed with the interagency review
of this proposal or if you wish to provide additional information about Cha
proposed pond. Because an Interagency site visit may help resolve some of the
potential concerns, v« will help arrange such a visit, if you wish.
If you have any questions,, contact Mr. Joseph Yanta at (612) 290-5361.
