t £ h <br />A RESOLUTION GRANTLNG <br />A CONDITIONAL USE PERMIT <br />PER >aiNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 2039 <br />WHEREAS Wally and Sharvl Carson (hereinatter the "applicants") have an <br />imerest in the propeny located at 3010 Somerset lane within the City of Orono (hereinafter "the <br />City") and legally described as: <br />Lot 1, Block 3, Old Crystal Bay Road Second Addition, Hennepin County, <br />Minnesota (hereinafter “property"); and <br />WHEREAS, per Municipal Zoning Code Section 10.03, Subdivision 19, the <br />applicants have filed a conditional use permit to permit the excavation <br />cubic yards of material occupying approximately 16,500 s.f. or .3 acres of a Type I wetla <br />an approximate 6’ depth. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />This application was reviewed as Zoning File #2039. <br />The property is located in the RR-IB Rural Residential Zoning District requiring <br />two acres of dry contiguous land. The property' consists of 3.5 acres. One acre <br />consists of a Type 1 wetland not considered a designated wetland of the City of <br />Orono. <br />The Orono Plannina Commission reviewed this application on August 21, 1995 <br />and recommended approval of the conditional use permit as amended based on <br />the follow'ing findings; <br />Pace I of 5
