The pond will be installed v iihin a o w <br />acre Tvpe I wetland occupying approximately 16,500 s.f. or .3 acres in area. Review Exhibit <br />J the open water area will be created at the northwest side of the lot. The current lot is not <br />developed. Major portions of the fill will be used around the pn^posed building site located out <br />of wetiaral area to the east of the lot. <br />Planning Commission wanted to assure that the pond would not end up as a decorative <br />pond w ith a grassed lawn area up to its edges. They specifically asked that the area surrounding <br />the open water area within the Type 1 wetland remain in its original state as no turther alteration <br />of the Tvpe I wetland is allowed. The existing vegetation within the Type 1 wetland must <br />remain in its original state. The Engineer has recommended that 10; 1 bench from the water line <br />to r below the water line be maintained to encourage emergent vegetation around the pond <br />perimeter. We ask that topsoil be salvaged for respreading over the disturbed areas and that the <br />areas be restored with a wetland seed mixture such as Mn/Dot mixture 250. <br />The applicant ’s surveyor has advised the Corps of Engineers will accept the alteration <br />permit under the authoritv of a nationwide permit allowing for an abbreviated review. The <br />Corps completed a site inspection on Thursday, September 7ih and they tound no problem with <br />the proposal for the pond but asked that all dredged soils be moved out of the wetland area <br />which is proposed bv applicant. The Corps representative also noted that purple loosestrife and <br />mother umiamed obnoxious weed was noted on site. A condition of thetr permit will be that <br />the applicant assumes responsibility for the removal of both obnoxious weeds. I he specitics will <br />be spelled out in the Corps permit. <br />Tlie Planning Commission unanimously approved the conditional use permit to allow the <br />excavation of a pond subject to the conditions set forth in the staff memo of August 10, 1995, <br />Page The enclosed resolution has been drafted per the findings and conditions of the Planning <br />Commission approval and includes the requirement that applicant must follow directives of the <br />Corps permit. <br />COL^’CIL ACTION REQITSTED: <br />To either deny, approve or amend the enclosed approval resolution. <br />September 8, 1995
