6.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the communit>-. <br />CONCLtSlONS, ORDER AND CONDITIONS <br />Based upon oiw or more of the above findings, the Orono Cit>- Council hereby <br />grants variances to the Municipal Zoning Code Sections noted above to permit construction ot <br />a two-story residence at 26.2’ x 38.5’ that may extend no closer than 30’ to the shoreline and <br />a single-story attached garage at 22’ x 22’ that may extend no closer than 63’ 6" to the <br />shoreline, a right side setback variance of 7 ’ or 70%. a street setback variance of 29 ’ 8" or 85% <br />and hardcover variances within the 0-75’ setback area at 1,097.7 s.f. or 20.5% and in the 75- <br />250’ setback area at 599 s.f. or 40.9%. This approval is subject to the following conditions: <br />1. <br />2. <br />3. <br />Applicant or applicant’s contractor shall be responsible for obtaining a demolition <br />permit for removal of the residence and single-stall garage structures. <br />Upon application for a building permit, applicant shall submit an amended survey <br />as shown on Page 7 of this resolution confirming the location of all improvements <br />as approved by the City. Applicant shall also provide an updated hardcover <br />analysis of all approved improvements and a drainage plan. <br />Authorities granted by this variance run with the property not w ith the applicant, <br />but are permissive only and must be e.xercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (August 28, 1996). <br />Violation of or non-compliance with any of the terms and conditions of this <br />variance shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of himself, his heirs, successors and assips, <br />hereby agrees to the recording of this resolution in the Chain of Title of the <br />propeny. <br />Page 4 of 7
