Denn, Commissioner <br />September 1, 1995 <br />Page 2 <br />discontinued and the new “Transportation System Management" <br />approach is adopted. <br />I am writing to encourage you to intervene in the process <br />and announce MnDots' selection of the new "Transportation System <br />Management" approach as soon as possible. Otherwise this matter <br />will drag on well into 1996 with further harm to all property <br />owners who own property along proposed routes. <br />Your letter was given to me by attorneys for a man named <br />Harold Panuska, who is a defendant in a case brought by me. The <br />letter was attached to an affidavit prepared by your secretary, <br />Lyn Isaacson. Her affidavit is attached. With the assistance of <br />your office in giving the letter to Panuska's attorneys, <br />Panuska's attorneys represented to Judge Catherine Anderson of <br />the Hennepin County District Court that 1) the Scott property was <br />in the South Corridor, and 2) the Statement that "there is only <br />the very remotest possibility that we would have to acguire Mr. <br />Scott's property" was a statement that "there is only the very <br />remotest possibility" that the South Corridor would be selected <br />as the preferred alternative. I trust that Panuska's attorneys <br />have accurately conveyed your views to District Court Judge <br />Anderson. On behalf of all persons affected by the South <br />Corridor, I encourage you to formally publish your view that <br />there is only the very remotest possibility that the South <br />Corridor would be selected so that the cloud on properties on <br />that corridor can be lifted. <br />Again, I applaud your attention to this matter and encourage <br />you to end the indecision and harm to property owners by the end <br />of 1995. <br />Thank you. <br />Very truly yours. <br />Alan G.
