SECTION 3. Extension of Interim Ordinance. The Cit> Council finds that it <br />would be unwise, improper and unjust to grant preliminary' subdivision approval or other permits <br />and approval for private drivew'ays which serve three or more residences as noted above until <br />the study as provided in Section 2 has been completed. Section 4 ot Ordinance #138, 2nd Series <br />allows the duration of said Ordinance to be extended by adoption ot a subsequent ordinance for <br />up to 18 additional months after the September 11, 1995 expiration date. Therefore, the City <br />Council hereby extends the interim Ordinance per the provisions of Section 5 below. <br />SECTION 4. Restrictioas on the Granting of Preliminary Subdivision ApEroyaJ <br />and Building Permits. No preliminary subdivision approval shall be given by the Council for <br />any subdivision or building permit for which application has not already been made tor private <br />driveways to serve three or more residences. <br />SECTION 5. Duration . This Ordinance shall expire on March 11, 1996, without <br />Council action, or it may be repealed earlier if the Council detennines that the requisite smdies <br />have been completed and adopted and the appropriate evaluation and action including any <br />necessary revisions of the zoning code, have been finalized. The duration ot this Ordinance may <br />be extended by adoption of a subsequent Ordinance for a total ot not more than 12 additional <br />months. <br />SECTION 6. Variances. The Council may grant a variance to this Ordinance <br />if the Council finds after careful review of all the facts that a proposal is not contrary to the <br />intent of the comprehensive community management plan, that it is compatible with the zoning <br />and official control amendments being considered by the City, that it does not adversely impact <br />the health, safety or welfare of the citizens and that it otherwise meets the requirements of the <br />Orono City Code and state law. <br />SECTION 7. Separabilirs'. Every' section, provision, or pan of this Ordinance <br />is declared separable from every other section, provision, or pan; and if any section, provision, <br />or pan thereof or action taken hereunder shall be held invalid, it shall not atfect any other <br />section, provision, or part. <br />SECTION 8. This Ordinance shall be published in the THE PIONEER and THE <br />LAKER and shall be effective immediately. <br />Adopted by the City Council of the City of Oiono on the 11th day of September, <br />1995. by a vote of_____ayes and _____nays. <br />ATTEST: <br />Dorothv M.
