w <br />A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.22. SUBDIVISIONS 1 AND 2 <br />AND SECTION 10.56, SUBDIVISION 16 (L) <br />HLE #2050 <br />WHEREAS, William Toles (hereinafter "the applicant") is owner of the property <br />located at 3165 North Shore Drive within the City of Orono (hereinafter "City") and legally <br />described as follows: <br />Exhibit A attached (hereinafter "the propeny"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Sections 10.22, Subdivision 2 and 10.56. Subdivision 16 (L) to permit the <br />construction of a swimmimi pool which results in hardcover in excess of the 25^ hardcover <br />normally allowed in the 75-250’ lakeshore setback zone, and a variance to Section 10.22. <br />Subdivision 1 to allow such swimming pool to encroach past the average lakeshore setback line <br />where no encroachment is normally allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />.Minnesota: <br />3. <br />FCSDINGS <br />1.This application was reviewed as Zoning File #2050. <br />2.The propeny is located in the LR-IB. Single Family Lakeshore Residential <br />Zoning District. <br />The Orono Planning Commission reviewed this application on August 21, 1995 <br />and recommended approval of the proposed variances based upon the following <br />findings: <br />Page I of 7
