4. <br />5. <br />E.Tlw curvature of the shoreline to the southeast of the property intensifies <br />the impact of the lakeshore setback upon limited building envelope of this <br />propert)’. <br />The City Council finds that the conditions existing on this propertv’ are peculiar <br />to it and do not apply generally to other property' in this zoning district; that <br />granting the variances would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Pl?n of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to the Municipal Zoning Code Sections noted above to permit ^f'nstruction of <br />a two-story residence at 26.2’ 38.5 ’ that may extend no closer than 30 ’ to the . noreline and <br />a single-story attached garage at 22’ x 22’ that may extend no closer than 63 ’ 6 ” to the <br />shoreline, a right side setback variance of 7’ or 70%, a street setback variance of 29’ 8" or 85% <br />and hardcover variances within the 0-75’ setback area at 1,097.7 s.f. or 20.5% and in the 75- <br />250’ setback area at 599 s.f. or 40.9%. This approval is subject to the following conditions: <br />1.Applicant or applicant’s contractor shall be responsible for obtaining a demolition <br />permit for removal of the residence and single-stall garage structures. <br />Upon application for a building permit, applicant shall submit an amended survey <br />as shown on Page 6 of this resolution confirming the location of all improvements <br />as approved by the City. Applicant shall also provide an updated hardcover <br />analysis of all approved improvements and a drainage plan. <br />Pace 3 of 6
